Please read through this carefully as you will be agreeing to all of it.
General Terms and Conditions These terms are between you and Top Edge Services LLC, referred to here as "Top Edge Hosting" or "Top Edge" or "topedgehosting.com" or "topedgeservices.com". Any breach of these terms and conditions may result in immediate suspension or termination of our services and will void all possibilities of a refund. If possible, we will try to warn you first before suspension, but it is our discretion.
Some of our services are offered as "unlimited", but with some restrictions apply: Domain names that that you purchase through us and we register on your behalf will be registered and renewed in our name. But they can be transfered to you at your request as long as you have not violated our terms. Registration of domain names cannot be cancelled or altered once the order has been processed. Before ordering, please be certain that the name is the one you want, is spelled exactly the way you want it, it cannot be refunded or changed unless you pay an additional fee. Your information You agree to be sure that you keep your information up to date and correct, including all contact information. You also agree to keep your login information private. You also agree that it is your responsibility to make sure you receive our emails and that they are not blocked by SPAM filters, etc. Our Privacy Policy Information given to Top Edge Services will not be sold or given to any third party without the users written permission, unless required to by law. Users agree not to collect or harvest any users information that may be on Top Edge Services' websites. Some user information may be shared with other members of Top Edge Services' sites, for example usernames, links, etc. Billing All services are prepaid. Hosting services are month-to-month. We allow you to pay us through Paypal.com, Alertpay.com or by credit card. All of these methods of payments are done on an automatic method (also known as a subscription payment). The only thing you need to do is make sure that there is enough money in your account for the charge to clear. If the charge does not clear for ANY reason we will give you 5 days to fix it or get us a replacement method of payment. After the 5 days of non-payment, we will suspend your account. If you are a reseller, this also means that we will suspend all the sites that you have under your reseller account. We will not reopen or unsuspend the account until payment has been completed. This also means that, if you pay us through your Paypal or Alertpay account and you use a checking account to fund the payment, it may take 4-7 days for the funds to clear. Top Edge Hosting reserves the right to delay setting-up or unsuspending or performing any service until funds have cleared completely. If your account is suspended and left unpaid for 30 days, you agree that Top Edge Hosting may terminate the account completely therefore erasing all content stored on our servers. Billing due dates are each month and generally the anniversary of the day you originally paid. Some of our payment service providers (Paypal, Alertpay and Credit Card) vary slightly how they manage their susbscription payments. Most are made on or within a day the anniversary. So if your first payment was on the 5th of May the next payment would most likely be on the 5th of June. However, if you paid your first payment to Top Edge Hosting on the 30th of January your next payment may fall on the 28th of February since ther is not a 30th of February. Hosting Refunds/Money Back Guarantee Any refunds including Top Edge Hosting's money back guarantee, will be done on a pro-rated bases for services that you have not yet been received. Also all refunds would be credited back to you by the same method you paid the original payment. You agree that anyone including yourself, who violates these terms is not eligable for ANY refunds. You also agree that all refund requests must be submitted to Top Edge Hosting 5 days in advance, and those 5 days that you continue to receive our services will NOT be refundable. As an example: if you paid Top Edge Hosting $10 by Paypal for 30 days of hosting, and you did not violate our terms, and you requested a refund on day 10 of the 30 days, Top Edge Hosting could issue the refund on day 15 of your hosting, terminate your account and issue you a refund of $5 for the remaining 15 days that you would not receive Top Edge Hosting's services. Top Edge Hosting will not issue refunds to anyone who did not pay us directly. All refunds will be made to the person who paid Top Edge Hosting. Domain Names Refund Policy You agree that domain name purchases will NOT be refundable. However, we will transfer the domain name control over to you and you will get the possesion over it and any remaining time that is left from the year for which it was registered. Violation of any of our terms of service may void transfer of the domain name to you and Top Edge Hosting will be able to retain or do what we like with the domain name. Design/Programing Refund Policy You agree that if you pay Top Edge Hosting for any design or programming work that it is only refundable based on how much work has already been performed. The percentage of work completed is up to Top Edge Hosting to determine. So if you paid for design or programming work and our designers completed 50% of the work then you agree that you will only receive a 50% refund. Activation or Reactivation Fees Refund Policy You agree that any and all activation fees or reactivation fees are NOT refundable. Resellers As a reseller your client's agreement is between you and your clients. There is NOT an agreement between Top Edge Hosting and Your clients. You are responsible to make sure your clients obey and follow our terms and/or conditions. You also agree that you are responsible for your clients content and actions and that their content and actions may affect your reseller account with Top Edge Hosting, and your account may be suspended or terminated because of your clients. In most cases we will issue a warning to you and suspend or terminate your clients account. You agree that we may terminate or suspend any of your client accounts that violate or terms and/or conditions without notice to you or your clients. You agree that your cleints will pay you directly and you are responsible to set up and maintain their hosting accounts. Also you agree that you are responsible to manage all payments between you and your clients and any payments or non-payments between you and your clients do not affect this agreement between you and Top Edge Hosting. You agree that you are responsible to offer all support to your clients. However, as our client, YOU may contact Top Edge Hosting for support where Top Edge Hosting would need to be involved. Your clients should not contact us directly for support. Any conflicts, problems, etc. between you and your client is between you and your client and will not affect this agreement between you and Top Edge Hosting. Any refunds that your clients demand are to be settled by you and will not be paid directly or indirectly by Top Edge Hosting for any reason. You agree that it is your responsiblility to have an agreement simular to this one between you and your client. All services that we provide are directly with you and not with your client. Restricted Content and Scripts
In the interests of all our clients, we do not allow certain content, scripts and programs to be hosted on our servers. This includes:
Domain Registration & Pointing Restrictions Domain registration and pointing is done in good faith. Should we however discover that any domain we have registered and pointed is being used in any activity recognised by the any United States legal authorities or any other similar Government agency as illegal, we reserve the right to immediately and without warning, act in the public interest and cease the pointing. This will be most strictly applied in all instances of fraudulent activity and online scams. Restricted Activities Email spamming of any nature. Bulkmail may be sent out as long as it is double opt-in and limited to reasonable batches per hour. The use of any automatic or self-installing scripts that are triggered by a visit to a page on your website or by clicking on a link that does not specifically state that it will create an installation (and detail exactly and accurately what the installation is). This doesn't include normal pop-ups/pop-unders or other innocuous (albeit irritating) scripts. It refers specifically to scripts that interfere with the free choice of your site users, eg. any scripts that may be considered to be malware: auto-dialers, browser hijackers, trackers, data-miners, etc. Your diskspace or bandwidth may not be resold. This includes any other aspect of your hosting package as well. If you are interested in a reseller account, please sign up for our reseller options. Limited Liability We offer no guarantees other than those clearly stated in the guarantee section/s of this site, or explicitly stated in any correspondence with you. We reserve the right to change any aspect of our terms of service at any time and will make every endeavour to notify clients of this via both email and our member area. Should the terms and conditions published on this page at any time differ from those shown in any other form or format, the content on this page will be taken to constitute the current and applicable terms and conditions. Every precaution has been taken to protect our servers. However, in the event of the bizarre, we accept no liability for loss of service or failure to provide service due to any act of war, civil unrest, violence, terrorism, third-party failure or any unforseeable act of God. Any uptime guarantees that we make do not include a downtime experienced due to any act of war, civil unrest, violence, terrorism, third-party failure or any unforseeable act of God. We accept no liability for any loss or damage that may be caused to your site or its ability to function, where this is caused by your addition to, removal or alteration of any content, software, program or account component. We reserve the right to instantly terminate any account that is placing the server or the functioning of other client sites at risk. The liability of Top Edge Hosting is at all times limited to the amounts paid by you for any service that has given rise to the question of liability and is limited to the extent of our guarantees provided. Although we take every care, we do not accept responsibility for loss or damage to any items, graphics, pictures, etc. given to us for the creation of a website. Please make sure that you give us good quality copies and not originals. Termination Hosting contracts may be terminated by yourself with the giving of 7 day notice in writing (using our contact form). Notice must be given 7 days prior to the next payment to avoid incurring any additional months fee. All payments due up to the end of the notice period must also be made at the time that notice is given. All of your files and information will be kept on our servers until the end of the notice period to allow you sufficient time to transfer your site, provided that all payments due up to the end of the notice period have been made in full at the time of giving notice. Top Edge Hosting reserves the right to terminate any existing service or part of any existing service, to any client, at any time and for any reason. Should Top Edge Hosting excercise the right to refuse or terminate any service, Top Edge Hosting hereby further reserves the right to do so without any reason or explanation being given. Should Top Edge Hosting terminate any hosting service for any reason other than breach of our terms and conditions or breach of good faith, the client will be given sufficient notice to allow him/her time to take the required backups and move to another hosting provider. In the event of a client's hosting being terminated by either the client or by Top Edge Hosting, Top Edge Hosting accepts no responsibility for ensuring that the client has a recent backup of their website or that transition to an alternative hosting provider occurs timeously and without complications. This is the sole responsibility of the client. Should you choose to move your hosting elsewhere, we therefore advise that you have your new host contact us as soon as possible for the transfer of your domain, which we undertake to assist with as speedily as possible. - We do not penalise clients for leaving us. General Top Edge Hosting hereby reserves the right to refuse any and all services to any potential client, for any reason whatsoever. No leniency that we may show in terms of any of the above at any time, will in any way and under any ciscumstances constitute a waiver of any of our rights to enforce any and all of our terms and conditions at any time in the future.
